A: An infestation from an animal, insect or pest would have an adverse affect on a buyer’s use and enjoyment of the property, and therefore is considered a material fact and needs to be disclosed. Some pests may pose serious structural damage. Others may carry disease that would pose a threat to one’s health. Some individuals may have allergies to certain animals or insects.
Another concern stemming from infestations is exposure to pesticides and insecticides. Individuals prone to asthma may have a reaction to the chemicals found in pesticides and insecticides. Depending on how recent the application of these chemicals occurred on the property, a potential buyer may have health issues that stem from exposure to these chemicals.
